| On Wednesday December 8, 2004, Giza Criminal court reconsiders the case No. 28608/ 2003, El-Haram, in which five citizens are accused of killing the husband of the actress Habeba where an investigator is accused also of torturing the actress to force her to confess a killing crime, as Giza Criminal court postponed reviewing the case in session of October 3, 2004 to the session of tomorrow to hear the testimonies of defense witnesses and the attendance of lawyer on behalf of the first and fourth suspects. On February 2, 2004, the Cassation court decided to annul the ruling of Giza Criminal court to punish the actress Habeba to ten years in prison with hard labor as a result of killing her husband and returning the case to the Appeal court to specify a circuit in the Criminal court to consider the case again and decided to consider the case with the case of the five suspects accused of killing her husband and the investigator accused of torturing her to confess of killing her husband. This trial came after the decision of the Attorney General to refer the officer Yasser Al-Akad in the criminal investigations bureau of the public security, after posing to him an accusation of torture and forcing the actress Habeba to confess a crime she did not commit, and forging the official reports when he was occupying the position of the head of the Investigation Bureau in the Al-Haram police station then. This decision comes after the prosecution bureau in southern Giza took over the investigations with the aforementioned officer in the incident of the torture of the citizen Habeba Mohammed Sa’ed and forcing her to confess of killing her husband/ Attallah Ga’far Attallah “Quatarian”. That is why she was condemned in this crime and was sentenced to ten years in prison, whereas she spent almost five years. Suddenly, the true suspects appeared and confessed of committing the crime, and that is what the investigations proved, in addition to the report of the legal medicine, which elucidated that the crime happened according to the confession of the true suspects not the confession of Habeba, whereas the head of the Investigation Bureau threatened her to strip her from her clothes and beat her in different parts on her body, and she was injured roughly as a result. It is worth mentioning that, HRAAP submitted a complaint to the Attorney General/ Maher Abdel-Wahed in 4/12/2003 for investigating in the incident of the torture of Habeba and forcing her to confess a crime, she did not commit. In addition to the incident of the torture of four other citizens from Toukh to force them also to confess a crime they did not commit. The complaint was registered as No. 12207 in 11/12/2003, Cairo appeal prosecution, then it was registered as No. 767/ 2003 complaints of the Attorney appeal, then it was sent to the southern Giza prosecution under the issued No. 6197 in 13/12/2003, and it was signed to be reviewed and taking the necessary procedures.
